Medical Alert System Terms and Conditions

Below are the terms and conditions of the Medical Alert (also called Personal Emergency Response Systems (PERS) contract. You can cancel the contract at any time simply by returning the equipment back to us. When you purchase your Medical Alert system online, you will be asked to acknowledge these terms & conditions, so please read through them.










By submitting a online order form, you or your caregiver (hereinafter referred to as “Subscriber”, “Customer” or “Purchaser”) offer to purchase a personal emergency response system equipment and service (hereinafter referred to as "PERS") from LIVE AT HOME Monitoring (hereinafter referred to as “LIVE AT HOME” or “Seller”). Subscriber and LIVE AT HOME agree to all of these Terms and Conditions (hereinafter referred to as “Agreement” or “Contract”) set forth in this document. It shall be in LIVE AT HOME’s discretion to accept or reject Subscriber’s order. If LIVE AT HOME accepts Subscriber’s order, this Agreement constitutes a Contract between LIVE AT HOME and Subscriber governing the purchase of the PERS through LIVE AT HOME’s online shopping cart service by Subscriber.

Both LIVE AT HOME and Subscriber hereto agree that:

1. PROPERTY OF LIVE AT HOME: LIVE AT HOME shall lease to Subscriber the PERS and the PERS remains the property of LIVE AT HOME. LIVE AT HOME shall provide all of the necessary devices and equipment for the duration of this Agreement, with the understanding that the entire system is and shall always remain the sole personal property of LIVE AT HOME and shall not be considered a fixture or part of the realty, and Subscriber shall not permit the attachment thereto of any apparatus not furnished by LIVE AT HOME.
2. INSURANCE: This Agreement is not an insurance policy. LIVE AT HOME is not an insurance carrier, broker, representative or agent. LIVE AT HOME does not offer insurance.
3. SUBSCRIBER RESPONSIBILITIES. Subscriber agrees to the following responsibilities:
A. Subscriber shall install the PERS in accordance with the installation instructions provided with the PERS.
B. Upon installation, Subscriber shall conduct an Initial Test of the PERS to validate the PERS’s successful operation immediately upon receipt of the PERS.
C. Subscriber shall test the PERS throughout the inside and outside of the Subscriber’s home.
D. Subscriber shall periodically test, at no additional charge, the PERS to verify the PERS’s continued successful operation at least once every 21 days using the pendant transmitter.
E. Subscriber’s continued use of PERS after the Initial Test shall indicate Subscriber’s acceptance that the PERS is fully functional.
F. Subscriber shall not attach or connect any apparatus or device to the PERS.
G. Subscriber shall supply continuous and uninterrupted 110 volt circuit as required to power the PERS.
H. Subscriber shall provide uninterrupted telephone service or any other equipment that may be deemed necessary to maintain and keep the PERS operational.
I. Subscriber shall provide responders access to their home.
J. Subscriber shall contact LIVE AT HOME by phone during regular business hours when any responder information or information that needs to be supplied to responders or emergency personnel changes.
K. Subscriber shall protect PERS from causes that could render the PERS inoperable.
4. TERM OF CONTRACT: RENEWALS: The term of this Agreement shall be for an Initial Period indicated by the first payment period, either monthly, quarterly and annually. This Agreement will automatically renew for the same period as the Initial Period until cancelled in accordance with the cancellation paragraph stated below.
5. CANCELLATION: This Agreement may be cancelled by the Subscriber at any time but only by calling LIVE AT HOME during regular business hours. For this Agreement to be cancelled, LIVE AT HOME must provide a Return Authorization Number to Subscriber, and this Return Authorization Number must be clearly displayed on both the inside and outside of the returned shipping container. The entire contents of the PERS must be returned in working order without marks or blemishes. If the PERS is returned with missing contents, not in working order, or with marks or blemishes, LIVE AT HOME will charge Subscriber for the missing contents, non working equipment, or for the marked or blemished equipment. If the Subscriber cancels the service and does not return the PERS to LIVE AT HOME within 14 calendar days of the Return Authorization Number being provided to Subscriber, LIVE AT HOME may assume the Subscriber has either lost or has chosen to purchase the PERS without monitoring service, and LIVE AT HOME will charge the Subscriber the Fair Market Value of the PERS without monitoring service. Subscriber’s account will remain active and billable until LIVE AT HOME receives at its location, either the PERS supplied to Subscriber or the Fair Market Value (or prorate portion thereof) is charged to Subscriber for lost, purchased or missing PERS components. Subscriber is responsible for all shipping costs to LIVE AT HOME including container, packing, tracking, delivery certification services and insurance. Subscriber is advised to insure the PERS for the Fair Market Value of the PERS for return shipping to LIVE AT HOME.
6. FAIR MARKET VALUE WITHOUT MONITORING SERVICE: The Fair Market Value of the PERS without monitoring service is $475 (four hundred and seventy five dollars).
7. TERMINATION: Subscriber may cancel this Agreement in accordance with the cancellation paragraph stated above. LIVE AT HOME may, without prior notice or communication to Subscriber, suspend or terminate its services, in LIVE AT HOME’s or designee communication center’s sole discretion, in event of Subscriber’s default in performance of this Agreement or in event designee communication center facility or communication network is nonoperational or Subscriber’s system is sending excessive communication or Subscriber’s account is past due.
8. REFUND POLICY: Subscriber may cancel this Agreement pursuant to any statutory authority within 30 days or within such time as such statute specifies upon such cancellation (whichever is longer), and upon return of PERS to LIVE AT HOME in accordance with the cancellation paragraph stated above, LIVE AT HOME will refund to Subscriber any amount paid for the PERS and any advance payment for services not yet rendered less shipping costs from LIVE AT HOME to Subscriber. Subscriber is responsible for all return shipping costs, container, packing, tracking, delivery certification services and insurance. Subscriber is responsible for the Fair Market Value of the PERS until it is properly returned to LIVE AT HOME. Subscriber’s account will remain active and billable until LIVE AT HOME receives at its location, either the PERS supplied to Subscriber or the Fair Market Value (or portion thereof) is charged to Subscriber for lost, kept or missing PERS.
9. PAYMENT: Subscriber authorizes LIVE AT HOME to charge Subscriber’s credit card on file or debit checking account for the recurring payment of the PERS for the term of the contract including renewals until cancelled in accordance with the cancellation paragraph stated above. Subscriber authorizes LIVE AT HOME to charge Subscriber’s credit card on file or debit checking account for additional charges associated that may be incurred with the cancellation of the service. Payment is due the first of each month and is considered Past Due by the fifth of each month. LIVE AT HOME may impose a late fee of $15.00 (fifteen dollars) per month on any account Past Due. LIVE AT HOME may charge Subscriber $35.00 (thirty five dollars) for non sufficient fund payments or payment denied requests. Past Due accounts may be charged the Fair Market Value of the PERS if account remains in a delinquent status for more than 45 days and PERS is not properly returned to LIVE AT HOME in accordance with the cancellation paragraph stated above.
10. INCREASES OF MONTHLY CHARGE: LIVE AT HOME shall be permitted to increase the charges provided for herein at any time after the first year of service upon giving notice to the Subscriber.
11. REFERRAL DISCOUNTS: From time to time, LIVE AT HOME may offer a Customer referral discount program. These discounts may be started, terminated, changed or discontinued at LIVE AT HOME’s sole discretion, at any time and without notice. Referral discounts, if in effect, are credited to the Customer’s monthly payment only if the Customer’s referral becomes a paying PERS LIVE AT HOME customer and is 100% current on all payments to LIVE AT HOME. Referral discount payments are credited to Customer’s account approximately 45 days after LIVE AT HOME receives the referred customer’s payment and if the referred customer was on the PERS service for the entire month. Partial months, which are usually the first and last month of service, are not credited to the Customer for the referral discount. If the aggregate sum of the Customer’s referral discount is greater than the Customer’s payment, then LIVE AT HOME will pay to the Customer the amount of the credit once the credit amount exceeds a $75 balance less a check payment, processing & mailing fee.
12. PERSONAL EMERGENCY RESPONSE SYSTEM CENTRAL OFFICE MONITORING: Upon receipt of a signal, LIVE AT HOME or its designee communication center, shall make every reasonable effort to notify Subscriber, Subscriber’s respondents designated by the Subscriber, and/or appropriate municipal emergency response services such as police or fire department as designated by Subscriber. Subscriber acknowledges that signals which are transmitted over telephone lines, or other modes of communication pass through communication networks wholly beyond the control of LIVE AT HOME and are not maintained by LIVE AT HOME and, therefore, LIVE AT HOME shall not be responsible for any PERS failure which prevents transmission signals from reaching the central office monitoring center or creates a transmission signal that was not intended and any consequential damages arising therefrom. Subscriber agrees to furnish LIVE AT HOME with a written list of names and telephone numbers of those persons Subscriber wishes to receive notification of emergency conditions together with a list of all allergies and medical conditions subscriber wishes to be available to all personal emergency response personnel and medical personnel. All changes and revisions shall be supplied to LIVE AT HOME in writing or by initiating a test of the PERS and communicating all changes and revisions to the designee communication center. Subscriber acknowledges that LIVE AT HOME provides no response to the PERS signal except notification to the appropriate party, and that the provisions of this Agreement exculpating and limiting LIVE AT HOME's liability are fully applicable to the PERS and monitoring. LIVE AT HOME may, without prior notice, suspend or terminate its services, in designee communication center’s sole discretion, in event of Subscriber’s default in performance of this Agreement or in event designee communication center facility or communication network is nonoperational or Subscriber’s system is sending excessive communication. LIVE AT HOME is authorized to record all telephone conversations and shall own such recordings.
13. SUBSCRIBER'S CARE OF EQUIPMENT: REPAIRS AND ADDITIONS: Subscriber agrees not to tamper with, remove or otherwise interfere with the PERS. The PERS shall remain in the same location as installed and Subscriber agrees to bear the cost of repairs, replacement, relocation or additions to the system made necessary as a result of any painting, alteration, remodeling or damage, including damage caused by unauthorized intrusion to the premises, lightning or electrical surge, except for ordinary wear and tear, in which event repair or replacement shall be made by LIVE AT HOME without additional charge. Batteries and other obsolete components are not included in this Agreement and will be repaired or replaced at Subscriber's expense.
14. TELEPHONE SERVICE IS NECESSARY AND SUBSCRIBER’S RESPONSIBILITY: Subscriber acknowledges that the PERS plugs into a standard telephone jack and communicates over standard telephone lines using two way voice communication. If Subscriber uses a VOIP Internet based system for telephone service, the Subscriber must contact LIVE AT HOME by phone during regular business hours so LIVE AT HOME can provide a VOIP capable PERS (DigiCare) at an additional charge. The standard PERS will not work with a VOIP Internet connection. DO NOT USE THE STANDARD PERS WITH A VOIP ENABLED TELEPHONE SYSTEM.
15. SUBSCRIBER'S DUTY TO SUPPLY ELECTRIC AND TELEPHONE SERVICE: Subscriber agrees to furnish, at Subscriber's expense, all 110 volt AC power and electrical outlets and receptacles, telephone hook-ups, telephone service, RJ31X telephone jack or equivalent, as deemed necessary by LIVE AT HOME in its sole discretion. Failure to install an RJ31X telephone jack by Subscriber shall relieve LIVE AT HOME of any and all liabilities for any failure to communicate that may occur as a direct result of such failure. The PERS requires connection to a private telephone line. LIVE AT HOME is not responsible in any way for the operation or maintenance of any appliance, instrument, or the telephone system to which the PERS is connected.
16. DELAY IN INSTALLATION: LIVE AT HOME shall not be liable for any damage or loss sustained by Subscriber as a result of delay in the delivery of PERS, installation of PERS, PERS failure, or for interruption of service due to electric failure, strikes, walk-outs, war, acts of God, or other causes, including LIVE AT HOME's negligence in the performance of this Agreement, and Subscriber shall not be relieved from payments due under this Agreement for such period.
17. TESTING AND SERVICE OF PERSONAL EMERGENCY RESPONSE SYSTEM: LIVE AT HOME and Subscriber agree that the PERS, once installed and initially tested by Subscriber, is in the exclusive possession and control of the Subscriber, and it is Subscriber's sole responsibility to test the operation of the PERS and to notify LIVE AT HOME if it is in need of repair or replacement. LIVE AT HOME shall not be required to service or replace the PERS unless LIVE AT HOME is notified by phone during regular business hours of such need. If LIVE AT HOME, through over-the-phone troubleshooting attempts, deems the PERS needs to be repaired or replaced, LIVE AT HOME will provide a Return Authorization Number to Subscriber. The Subscriber will then return the PERS to the address provided by LIVE AT HOME, and Subscriber will clearly mark the Return Authorization Number on both the inside and outside of the container. The Subscriber is responsible for the shipping, packing, tracking, certification and insurance costs. Upon return to LIVE AT HOME, LIVE AT HOME will perform an inspection of the PERS. If the returned PERS is deemed in need of repair or replacement, LIVE AT HOME will credit Subscriber’s account for 1 month service for the cost of Subscriber’s shipping cost to LIVE AT HOME and this credit will be Subscriber’s sole remedy for the PERS’s unavailability to Subscriber. If the returned PERS is deemed to be operational and the system failure was electrical or telephone service related, LIVE AT HOME will charge Subscriber a $75 inspection charge. LIVE AT HOME, in its sole discretion, may provide a new, used, repaired or equivalent PERS to Subscriber. LIVE AT HOME will be responsible for the shipping costs of the PERS back to Subscriber after repair or replacement. If LIVE AT HOME fails to repair or replace the PERS and return PERS to Subscriber within 10 business days of receiving the PERS from Subscriber, the Subscriber shall, upon request by phone to LIVE AT HOME during regular business hours, be credited an additional $1.50 (one dollar and fifty cents) per day beyond the 10 business days the PERS has not been received by Subscriber. This additional credit will be Subscriber’s sole remedy for the unavailability of the PERS to Subscriber. Upon Subscriber’s receipt of returned PERS, it is the Subscribers responsibility to immediately install and test PERS as previously indicated in this Agreement. LIVE AT HOME is not responsible for any emergency, request for service, inconvenience, injury or death, while Subscriber is without the PERS. In any lawsuit between the parties in which the condition or operation of the PERS is in issue, the Subscriber shall be precluded from raising the issue that the PERS was not operating unless Subscriber can produce a US Post Office certified or registered receipt, signed by LIVE AT HOME, evidencing that service was requested by Subscriber.
18, SUBSCRIBER TO INSURE LIVE AT HOME’s PERS: Subscriber shall insure LIVE AT HOME's PERS against fire and casualty and Subscriber agrees to name LIVE AT HOME in said insurance policy as "loss payee" to the Fair Market Value of the PERS as set forth hereinabove. Subscriber shall be responsible for any loss occasioned by fire or casualty and the cost of replacing or restoring the PERS. Notwithstanding the condition of Subscriber's premises, or LIVE AT HOME's impossibility of performance occasioned by condition of Subscriber's premises, Subscriber shall remain liable for monthly payments for the term of this Agreement without offset or reduction unless the service is cancelled in accordance with the cancellation paragraph stated above. Subscriber will still be responsible for the payment of the Fair Market Value of the PERS.
19. TERMINATION IN THE EVENT OF DEATH: This Agreement shall terminate upon Subscriber’s death and the return of the PERS by Subscriber’s representative at Subscriber’s expense to LIVE AT HOME. Subscriber’s representative must contact LIVE AT HOME by phone during regular business hours before returning PERS to LIVE AT HOME to cancel the Agreement because of Subscriber’s death. LIVE AT HOME will refund up to 1 month service for any advance payment of services not yet rendered to Subscriber’s account if Subscriber’s representative notifies LIVE AT HOME, provides a death certificate based on the Subscriber’s death and returns of all PERS is within 30 days of the Subscriber’s death. Subscriber’s account will remain active and billable until LIVE AT HOME receives at its location, either the PERS supplied to Subscriber or the Fair Market Value (or prorated portion thereof) is charged to Subscriber for lost, purchased or missing PERS components. Subscriber is responsible for all shipping costs to LIVE AT HOME including container, packing, tracking, delivery certification services and insurance. Subscriber is advised to insure the PERS for the Fair Market Value of the PERS for return shipping to LIVE AT HOME.
20. ASSIGNMENTS/WAIVER OF SUBROGATION RIGHTS: Subscriber shall not be permitted to assign this Agreement without written consent of LIVE AT HOME. Any such assignment without prior approval shall be deemed a breach of this Agreement. LIVE AT HOME shall have the right to assign this Agreement and shall be relieved of any obligations created herein upon such assignment. Subscriber on its behalf and any insurance carrier waives any right of subrogation Subscriber's insurance carrier may otherwise have against LIVE AT HOME or LIVE AT HOME's subcontractors or designee communications center arising out of this Agreement or the relation of the parties hereto.
21. INDEMNITY: Subscriber agrees to and shall indemnify and hold harmless LIVE AT HOME, its employees, agents, subcontractors and designee communications center, from and against all claims, lawsuits, including those brought by third parties, including reasonable attorneys' fees, and losses asserted against and alleged to be caused by LIVE AT HOME's performance, negligent performance or failure to perform its obligations under this Agreement. Parties agree that there are no third party beneficiaries of this Agreement.
22. REMOVAL OF PERSONAL EMERGENCY RESPONSE SYSTEM: Upon termination of this Agreement LIVE AT HOME shall be permitted to discontinue all PERS monitoring service and Subscriber shall at subscriber’s expense return, insured, certified, signature required, LIVE AT HOME PERS to LIVE AT HOME. If for any reason caused by Subscriber, or the owner of the premises if other than the Subscriber, said PERS is not delivered to LIVE AT HOME within 10 calendar days of such termination, Subscriber shall be deemed to have purchased the PERS without monitoring service for the agreed Fair Market Value stated in this Agreement.
23. LEGAL ACTION: The parties agree that due to the nature of the services to be provided by LIVE AT HOME the payments to be made by Subscriber for the term of this Agreement are an integral part of LIVE AT HOME's anticipated profits, and in the event of Subscriber's breach of this Agreement it would be difficult if not impossible to reasonably estimate LIVE AT HOME's actual damages. Therefore, in the event of Subscriber's default of this Agreement LIVE AT HOME shall be permitted to terminate all its services under this Agreement without relieving Subscriber of any obligation herein. Additionally, in the event of Subscriber's breach of this Agreement LIVE AT HOME may, at its option, either remove its PERS or deem same sold to Subscriber for the Fair Market Value of the PERS as specified in this Agreement. The parties waive trial by jury in any action between them. In any action commenced by LIVE AT HOME against Subscriber, Subscriber shall not be permitted to interpose any counterclaim. Any action by Subscriber against LIVE AT HOME must be commenced within one year of the accrual of the cause of action or shall be barred forever. All actions or proceedings against LIVE AT HOME must be based on the provisions of this Agreement. Any other action that Subscriber may have or bring against LIVE AT HOME in respect to other services rendered in connection with this Agreement shall be deemed to have merged in and be restricted to the terms and conditions of this Agreement. Should LIVE AT HOME refer this Agreement to an attorney, Subscriber shall pay LIVE AT HOME's legal fees. This Agreement shall be governed by the laws of the State of Texas. Subscriber submits to the jurisdiction of Texas and agrees that any litigation between the parties must be commenced and maintained exclusively in the State of Texas, and in Tarrant county where LIVE AT HOME’s principal place of business is located.
24. ADDITIONAL PAYMENTS: In addition to the payments set forth herein, Subscriber agrees to be liable for and pay to LIVE AT HOME any excise, sales, property, or other tax, telephone line charges, and any increases thereof, which may be imposed upon LIVE AT HOME because of this Agreement. Should LIVE AT HOME be required by existing or here after enacted law to perform any service or furnish any material not specifically covered by the terms of this Agreement Subscriber agrees to pay LIVE AT HOME for such service or material.
25. FALSE ALARMS/PERMIT FEES: Subscriber is responsible for all alarm permits and permit fees, agrees to file for and maintain any permits required by applicable law and indemnify or reimburse LIVE AT HOME for any fines relating to permits or false alarms. LIVE AT HOME shall have no liability for permit fees, false alarms, false alarm fines, police or fire response, any damage to personal or real property or personal injury caused by police or fire department response to alarm, whether false alarm or otherwise, or the refusal of the police or fire department to respond. In the event of termination of police or fire response by the municipal police or fire department this Agreement shall nevertheless remain in full force and Subscriber shall remain liable for all payments provided for herein. Should LIVE AT HOME be required by existing or hereinafter enacted law to perform any service or furnish any material not specifically covered by the terms of this Agreement Subscriber agrees to pay LIVE AT HOME for such service or material.
26. LIVE AT HOME'S RIGHT TO SUBCONTRACT SPECIAL SERVICES: Subscriber agrees that LIVE AT HOME is authorized and permitted to subcontract any services to be provided by LIVE AT HOME to third parties who may be independent of LIVE AT HOME, and that LIVE AT HOME shall not be liable for any loss, damage or injury sustained by Subscriber by reason of any other cause whatsoever caused by the negligence of third parties. Subscriber acknowledges that this Agreement, and particularly those paragraphs relating to LIVE AT HOME's disclaimer of warranties, exemption from liability, even for its negligence, limitation of liability and indemnification, inure to the benefit of and are applicable to any assignees, subcontractors and communication centers of LIVE AT HOME.
27. NO WARRANTIES OR REPRESENTATIONS: SUBSCRIBER'S EXCLUSIVE REMEDY: LIVE AT HOME does not represent nor warrant that the PERS will prevent any loss, damage, injury or death to person or property, or that the PERS will in all cases provide the protection for which it is installed or intended. Subscriber acknowledges that LIVE AT HOME is not an insurer, and that Subscriber assumes all risk for loss, death or injury to Subscriber's property or person. LIVE AT HOME has made no representation or warranties, and hereby disclaims any warranty of merchantability or fitness for any particular use. Subscriber's exclusive remedy for LIVE AT HOME's default hereunder is to require LIVE AT HOME to repair or replace, at LIVE AT HOME's option, any component or part of the PERS that is non-operational.
28. EXCULPATORY CLAUSE: The parties agree that LIVE AT HOME is not an insurer and no insurance coverage is offered herein. Subscriber's payments to LIVE AT HOME are for the rental and service of the PERS designed to reduce certain risks of loss, though LIVE AT HOME does not guarantee that no loss will occur. LIVE AT HOME is not assuming liability and therefore shall not be liable to Subscriber for any loss, injury or death sustained by Subscriber as a result of any cause whatsoever, regardless of whether or not such loss or injury was caused by or contributed to by LIVE AT HOME's negligent performance to any degree or failure to perform any obligation or strict PERSs liability. Subscriber releases LIVE AT HOME from any claims for contribution, indemnity or subrogation.
29. LIMITATION OF LIABILITY: The parties agree that the PERS is not designed or guaranteed to prevent any loss, injury or death. If, notwithstanding the terms of this Agreement, there should arise any liability on the part of LIVE AT HOME as a result of any cause whatsoever, regardless of whether or not such loss, damage, personal injury or death was caused by or contributed to by LIVE AT HOME's negligence to any degree or failure to perform any obligation or strict PERSs liability, such liability will be limited to an amount equal to four (4) times the monthly payment paid by the Subscriber to LIVE AT HOME at the time such liability is fixed, or to the sum of $250 (two hundred and fifty dollars), whichever is greater. If Subscriber wishes to increase LIVE AT HOME's maximum amount of such limitation of liability, Subscriber may, as a matter of right, at any time, by entering into a supplemental Agreement, obtain from LIVE AT HOME a higher limit by paying an additional amount consonant with the increase of liability. This shall not be construed as insurance coverage. This limitation applies irrespective of the nature, severity and cause of such injury, loss, death or damage, and irrespective of the legal theory of liability asserted against LIVE AT HOME.
30. PERSONAL MEDICAL DISCLOSURE AUTHORIZATION: Any medical or other personal information provided by subscriber to LIVE AT HOME may be disclosed by LIVE AT HOME to any personal emergency response personnel or medical personnel requesting same.
31. CONFLICTING DOCUMENTS: Should there arise any conflict between this Agreement and Subscriber's purchase order or other document, this Agreement will govern, whether such purchase order or document is prior to or subsequent to this Agreement.
32. CONTRACT EXECUTION: Any alteration or strikeover in the text of this pre-printed or online Agreement will have no binding effect, and will not be deemed to amend this Agreement. This Agreement may be executed by facsimile, and facsimile copies of signatures to this Agreement shall be deemed to be originals and may be relied on to the same extent as the originals. This Agreement may also be executed by electronic means by agreeing to the “Terms and Conditions for Personal Emergency Response Service Agreement” checkbox through the LIVE AT HOME website shopping cart during purchase of the PERS by Subscriber.
33. FORCIBLE ENTRY: Subscriber authorizes LIVE AT HOME and its designee communications center, in its sole discretion, to authorize entry to the Subscriber’s premises in the event a signal is transmitted to LIVE AT HOME or the designee communications center through the PERS. LIVE AT HOME and its subcontractors, agents, respondents, emergency personnel or designee communications center will not be held liable whatsoever for any damage or injury as a result of said entry.
34. FULL AGREEMENT/SEVERABILITY: This Agreement constitutes the full understanding of both LIVE AT HOME and Subscriber. LIVE AT HOME reserves the right in its exclusive discretion at any time without notice to amend, limit, modify, suspend, or terminate this Agreement or the website through which the PERS was ordered. Subscriber is hereby notified to bookmark the website indicated by this Agreement and periodically check the website to see any changes to this Agreement have been executed. This contract shall be governed by the laws of the State of Texas in Tarrant county. Should any statement or provisions of this Agreement be deemed void, all other statements and provisions will remain enforceable.
